Violation of any of the foregoing prohibitions may result in immediate termination of your access to the Services, as well as potential civil or criminal liability. The Company reserves the right to report any suspected illegal activity to law enforcement authorities.
4. Intellectual Property Rights
All content on the Site, including but not limited to text, graphics, logos, photographs, images, menu designs, video content, audio clips, digital downloads, data compilations, and software, is the exclusive property of Anthony's Coal Fired Pizza or its licensors and is protected by United States and international copyright, trademark, trade dress, patent, and other intellectual property laws.
The "Anthony's Coal Fired Pizza" name, logo, and all related product and service names, designs, slogans, and trade dress are trademarks or registered trademarks of the Company. 5. Payment Terms
All prices for food items, beverages, and related services are displayed on the Site and are subject to change without notice. Prices are listed in United States Dollars (USD) and do not include applicable sales taxes, delivery fees, or gratuities unless expressly stated otherwise.
By placing an order, you authorize Anthony's Coal Fired Pizza and/or its designated payment processors to charge the payment method provided for the total amount of your order, including all applicable taxes and fees. You represent and warrant that (a) the payment information you provide is accurate and complete, (b) you are authorized to use the payment method, and (c) charges incurred will be honored by your financial institution.
We accept major credit cards, debit cards, and other payment methods as indicated at checkout. We use industry-standard encryption and security protocols to protect your payment information. However, we are not responsible for any unauthorized access to your financial information that is beyond our reasonable control.
All sales are subject to confirmation. The Company reserves the right to refuse, cancel, or limit any order at any time, including after a transaction has been submitted, for reasons including but not limited to product unavailability, errors in pricing or product descriptions, suspected fraudulent activity, or concerns regarding the order's authenticity. In the event of a cancellation after payment has been processed, a full refund will be issued to the original payment method.
Refund and return policies for food products are subject to applicable health and safety regulations. Due to the perishable nature of food items, all sales are generally final. Refunds or replacements may be offered at the Company's discretion in cases where food items are demonstrably incorrect, unsatisfactory due to the Company's error, or fail to meet reasonable quality standards. Promotional codes, coupons, and discounts are subject to their own terms and conditions and may not be combined unless expressly permitted. The Company reserves the right to revoke promotional offers at any time for misuse or abuse.

The Company does not warrant that:
- The Site will be available, uninterrupted, timely, secure, or error-free at all times;
- The results obtained from use of the Site will be accurate or reliable;
- Any errors or defects in the Site will be corrected;
- The Site or its servers are free of viruses, malware, or other harmful components;
- Menu information, including pricing, availability, and nutritional content, is always current or accurate.
Allergen and nutritional information provided on the Site is furnished as a general guide only. Our kitchen facilities may process common allergens including, but not limited to, gluten, tree nuts, peanuts, dairy, eggs, shellfish, and soy. We cannot guarantee that any menu item is entirely free from cross-contamination. Customers with severe food allergies or dietary restrictions are strongly encouraged to contact us directly before placing an order. Anthony's Coal Fired Pizza is not liable for any adverse reactions arising from undisclosed allergens, and customers consume our products at their own risk.

7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE FEDERAL TRADE COMMISSION ACT AND APPLICABLE STATE CONSUMER PROTECTION LAWS, ANTHONY'S COAL FIRED PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR THE COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, OR ANY TRANSACTIONS CONDUCTED THROUGH THE SITE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE COMPANY'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO ANTHONY'S COAL FIRED PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. In such jurisdictions, the Company's liability shall be limited to the greatest extent permitted by applicable law.
Nothing in these Terms shall limit or exclude the Company's liability for (a) death or personal injury caused by its negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be limited or excluded under applicable law.
8. Indemnification
You agree to defend, indemnify, and hold harmless Anthony's Coal Fired Pizza, its parent companies, subsidiaries, affiliates, officers, directors, shareholders, employees, agents, licensors, service providers, and successors and assigns (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your use of or access to the Site or Services;
- Your violation of these Terms or any representation, warranty, or obligation set forth herein;
- Your violation of any applicable law, regulation, or the rights of any third party, including intellectual property rights or privacy rights;
- Any User Content you submit, post, or transmit through the Site;
- Your fraudulent, negligent, or otherwise wrongful conduct; or
- Any dispute between you and another user or third party arising in connection with your use of the Services.
The Company reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such event, you agree to cooperate fully with the Company in asserting any available defenses. You shall not settle any claim covered by this indemnification provision without the prior written consent of the Company.
9. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the United States and, to the extent applicable, the laws of the state in which Anthony's Coal Fired Pizza operates, without regard to any conflict of law principles that would require the application of the laws of another jurisdiction.
These Terms are also subject to applicable federal laws, including the Federal Trade Commission Act (15 U.S.C. § 45 et seq.) governing unfair or deceptive acts and practices, and any other applicable federal consumer protection statutes. Where applicable, California residents may have additional rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), and other California-specific consumer protection laws.
Subject to the dispute resolution provisions set forth in Section 10 below, you consent to the exclusive personal jurisdiction and venue of the federal and state courts located within the United States for the resolution of any disputes not subject to arbitration. You waive any objection to the laying of venue of any such proceeding in such courts and any objection that such courts are an inconvenient forum.
10. Dispute Resolution
10.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first contact Anthony's Coal Fired Pizza at [email protected] and provide a written description of the dispute, including the nature of your claim, the relief sought, and all relevant factual background. The parties agree to make a good-faith effort to resolve the dispute informally within thirty (30) days of the Company's receipt of the written notice. If the dispute is not resolved within that period, either party may proceed to formal dispute resolution as described below.
10.2 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Except for disputes that qualify for small claims court, all disputes, controversies, or claims arising out of or relating to these Terms, your use of the Site or Services, or any transaction with Anthony's Coal Fired Pizza that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in English and shall take place in the United States.
The arbitrator shall have the authority to award any relief that a court of competent jurisdiction could award, including injunctive or declaratory relief. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
10.3 Class Action Waiver
YOU AND ANTHONY'S COAL FIRED PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, SHALL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. NEITHER YOU NOR THE COMPANY SHALL HAVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR TO HAVE DISPUTES HEARD BY A JURY. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
10.4 Exceptions
Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information, without waiving the right to arbitrate all other disputes.
11. Term and Termination
These Terms shall remain in full force and effect for as long as you access or use the Site or Services. The Company reserves the right, in its sole and absolute discretion, to suspend or terminate your access to all or any part of the Site or Services at any time, with or without cause, and with or without notice, effective immediately.
Grounds for termination may include, without limitation:
- Breach of any provision of these Terms;
- Conduct that the Company believes is harmful to other users, the Company, or third parties;
- Provision of false or misleading information during account registration or order placement;
- Suspected fraudulent, abusive, or illegal activity; or
- Requests by law enforcement or other governmental agencies.
Upon termination, your right to use the Site and Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall so survive, including but not limited to Sections 4 (Intellectual Property Rights), 6 (Disclaimers), 7 (Limitation of Liability), 8 (Indemnification), 9 (Governing Law), 10 (Dispute Resolution), and 13 (Severability).
The Company shall not be liable to you or any third party for any termination of your access to the Site or Services.
12. Changes to Terms
Anthony's Coal Fired Pizza reserves the right to modify, update, revise, or replace these Terms of Service at any time, at its sole discretion. Changes will become effective immediately upon posting of the updated Terms to the Site, unless otherwise stated. 13. Severability

The unenforceable or invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable, consistent with the original intent of the parties, or if such modification is not possible, the provision shall be severed from these Terms entirely.
The failure of Anthony's Coal Fired Pizza to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by the Company in writing. A waiver of any particular breach or default shall not constitute a waiver of any subsequent breach or default of the same or any other provision.
These Terms constitute the entire agreement between you and Anthony's Coal Fired Pizza with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, proposals, and agreements, whether oral or written, between the parties relating to the Site or Services, except for any additional terms and conditions that may apply to specific features, products, or promotions offered by the Company.
